1. Identidad y domicilio del responsable

EIRA DENTAL GROUP, S. de R.L. de CV que opera bajo el nombre comercial Eira Dental Group (en adelante, "Eira"), con domicilio en Vicente Guerrero 10, Col. Centro, C.P. 40890, Zihuatanejo, Guerrero, México, es responsable del tratamiento de sus datos personales conforme a la Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP).

2. Datos personales que recabamos

A través de nuestro sitio web, WhatsApp y correo electrónico:

  • Nombre y apellidos

  • Correo electrónico y número de teléfono

  • Contenido de sus mensajes, incluyendo, en su caso, las fechas de su estancia en Zihuatanejo

Como paciente de la clínica:

  • Datos de identificación y contacto (nombre, fecha de nacimiento, domicilio, teléfono, correo electrónico)

  • Datos de facturación, en su caso (RFC, razón social, domicilio fiscal)

  • Datos de contacto de su dentista o médico tratante, cuando usted lo autorice

Datos personales sensibles: para prestarle atención odontológica, recabamos datos sobre su estado de salud, como antecedentes médicos y dentales, alergias, medicamentos, padecimientos, radiografías, tomografías, escaneos intraorales, fotografías clínicas y el expediente clínico. Estos datos son sensibles y se tratarán con las medidas de seguridad reforzadas que exige la ley, únicamente con su consentimiento expreso y por escrito, que se recabará en la clínica antes de iniciar cualquier tratamiento.

3. Finalidades del tratamiento

Finalidades primarias (necesarias para la relación con usted):

  1. Responder a sus consultas y solicitudes de información.

  2. Agendar, confirmar y dar seguimiento a sus citas.

  3. Realizar diagnósticos, planes de tratamiento y presupuestos.

  4. Prestar los servicios odontológicos y fabricar sus restauraciones en nuestro laboratorio.

  5. Integrar y conservar su expediente clínico conforme a la normatividad sanitaria aplicable.

  6. Dar seguimiento a su tratamiento, incluyendo consultas por videollamada.

  7. Hacer válida la garantía de los tratamientos.

  8. Emitir facturas y cumplir obligaciones fiscales y legales.

Finalidades secundarias (requieren su consentimiento y no son necesarias para la atención):

  1. Enviarle información sobre servicios, promociones o novedades de la clínica.

  2. Solicitar su opinión sobre la calidad de nuestros servicios.

  3. Utilizar fotografías o videos de su tratamiento, o su testimonio, en nuestro sitio web, redes sociales o materiales de difusión. Esto solo se hará con su autorización expresa y por escrito, otorgada en cada caso.

Si no desea que sus datos se traten para las finalidades secundarias, puede indicarlo en cualquier momento escribiendo a recepcion@eiradental.mx. Su negativa no afectará la atención que le brindamos.

4. Transferencias de datos

Sus datos personales podrán ser comunicados a:

  • Su dentista o médico tratante, en México o en el extranjero, para coordinar su atención, únicamente con su consentimiento.

  • Autoridades sanitarias, fiscales o judiciales, cuando exista una obligación legal o un requerimiento debidamente fundado.

Eira no vende ni comparte sus datos personales con terceros con fines comerciales.

También utilizamos proveedores de servicios que tratan datos por nuestra cuenta y bajo nuestras instrucciones, como alojamiento web (Squarespace), correo electrónico, mensajería (WhatsApp) y software de gestión clínica. Estos proveedores están obligados a proteger su información.

5. Derechos ARCO y revocación del consentimiento

Usted tiene derecho a Acceder a sus datos personales, Rectificarlos si son inexactos, Cancelarlos cuando considere que no se requieren para las finalidades señaladas, y Oponerse a su tratamiento para fines específicos (derechos ARCO). También puede revocar el consentimiento que nos haya otorgado.

Para ejercer estos derechos, envíe una solicitud a recepcion@eiradental.mx que incluya:

  • Su nombre completo y un medio para comunicarle la respuesta

  • Un documento que acredite su identidad (o la de su representante legal)

  • Una descripción clara de los datos y del derecho que desea ejercer

Le responderemos en un plazo máximo de 20 días hábiles a partir de la recepción de su solicitud. Si resulta procedente, la haremos efectiva dentro de los 15 días hábiles siguientes.

Tome en cuenta que el expediente clínico debe conservarse durante el plazo que establece la normatividad sanitaria, por lo que ciertos datos no podrán cancelarse antes de dicho plazo.

6. Limitación del uso o divulgación de sus datos

Puede solicitar en cualquier momento que dejemos de enviarle comunicaciones informativas o promocionales, escribiendo a recepcion@eiradental.mx o respondiendo directamente al mensaje recibido.

7. Uso de cookies y tecnologías similares

Nuestro sitio web utiliza cookies y tecnologías similares, propias y de terceros (como Squarespace y Google Maps), para su funcionamiento, para recordar sus preferencias y para obtener estadísticas de visitas. Estas tecnologías pueden recabar datos como su dirección IP, tipo de navegador, páginas visitadas y tiempo de visita. Puede desactivar las cookies desde la configuración de su navegador, aunque algunas funciones del sitio podrían verse afectadas.

2. Personal data we collect

Through our website, WhatsApp and email:

  • First and last name

  • Email address and phone number

  • The content of your messages, including, where applicable, the dates of your stay in Zihuatanejo

As a patient of the clinic:

  • Identification and contact details (name, date of birth, address, phone, email)

  • Billing details, where applicable

  • Contact details of your dentist or doctor, when you authorize it

Sensitive personal data: to provide dental care, we collect information about your health, such as medical and dental history, allergies, medications, conditions, X-rays, CT scans, intraoral scans, clinical photographs and your clinical record. This data is sensitive and will be handled with the enhanced security measures required by law, and only with your express written consent, which we will obtain at the clinic before any treatment begins.

3. Why we use your data

Primary purposes (necessary for our relationship with you):

  1. Answering your questions and information requests.

  2. Scheduling, confirming and following up on appointments.

  3. Diagnosis, treatment planning and cost estimates.

  4. Providing dental care and making your restorations in our lab.

  5. Creating and keeping your clinical record as required by health regulations.

  6. Following up on your treatment, including video-call consultations.

  7. Honoring the warranty on your treatment.

  8. Issuing invoices and meeting tax and legal obligations.

Secondary purposes (require your consent and are not necessary for your care):

  1. Sending you information about services, offers or clinic news.

  2. Asking for your feedback on our services.

  3. Using photos or videos of your treatment, or your testimonial, on our website, social media or promotional materials. This will only happen with your express written authorization, given case by case.

If you don't want your data used for secondary purposes, tell us at any time at recepcion@eiradental.mx. Saying no will not affect your care.

4. Sharing your data

We may share your personal data with:

  • Your dentist or doctor, in Mexico or abroad, to coordinate your care, only with your consent.

  • Health, tax or judicial authorities, when legally required.

Eira does not sell or share your personal data with third parties for commercial purposes.

We also use service providers that process data on our behalf and under our instructions, such as website hosting (Squarespace), email, messaging (WhatsApp) and clinic management software. These providers are required to protect your information.

5. Your rights (ARCO rights) and withdrawing consent

You have the right to Access your personal data, Rectify it if it's inaccurate, Cancel it when you believe it's no longer needed, and Object to its use for specific purposes. You can also withdraw any consent you've given us.

To exercise these rights, email recepcion@eiradental.mx with:

  • Your full name and how we should reply to you

  • A document proving your identity (or that of your legal representative)

  • A clear description of the data and the right you want to exercise

We will reply within 20 business days of receiving your request, and if it's approved, we'll carry it out within the following 15 business days.

Please note that clinical records must be kept for the period required by health regulations, so some data cannot be deleted before that period ends.

6. Limiting use of your data

You can ask us at any time to stop sending you informational or promotional messages by emailing recepcion@eiradental.mx or replying to the message you received.

7. Cookies

Our website uses cookies and similar technologies, both our own and from third parties (such as Squarespace and Google Maps), to make the site work, remember your preferences and measure visits. These may collect information such as your IP address, browser type, pages visited and time on the site. You can disable cookies in your browser settings, although some features of the site may not work properly.

8. Changes to this notice

We may update this notice due to legal changes or changes to our services or privacy practices. Any update will be posted on this page with the date of the last revision.

Before publishing

  • Legal entity name. The notice must name whoever legally owns the clinic (the razón social or the person registered with the SAT), not just the trade name. If Eira operates under the Dadora structure or another entity, use that name.

  • Patient consent in the clinic. The website notice doesn't replace the written consent for health data. If patients don't already sign a consent form that references the privacy notice, add one to your intake paperwork.

  • Lawyer check. This covers the standard requirements, but I'm not a lawyer. Since you have a tax advisor, ask them or a lawyer to review it once, especially the legal entity and the record-keeping section.

  • Footer link. Add "Privacy notice / Aviso de privacidad" to the footer on every page.
